1. Scope of This Disclaimer#

This notice of disclaimer applies specifically to the data, analytics, statistics, charts, market intelligence, geographic visualisations, and any derived content (collectively, "Data Content") provided through the Infra-Analytics and Infra-Maps features of the Infra-Backer platform ("Platform"), operated by Infra-Backer Limited.

This disclaimer supplements and must be read alongside our Terms of Use and Privacy Policy, which are available on the Platform. This disclaimer forms part of the Terms of Use. In the event of any conflict between this disclaimer and the Terms of Use in relation to Data Content, this disclaimer shall prevail.

Infra-Maps is available to Registered Users, except the project map, which currently displays a preview ("coming soon"). Infra-Analytics is being introduced and currently displays a preview ("coming soon"); this disclaimer applies to its Data Content as and when it becomes available.

By accessing or using any Data Content on the Platform, you confirm that you have read, understood, and accepted this disclaimer.

2. Data Sources and Compilation#

The Data Content presented through Infra-Analytics and Infra-Maps is derived from publicly available databases, government publications, regulatory filings, and other third-party sources. We compile, process, and present this data to provide market intelligence to Platform users.

You acknowledge and agree that:

• Data Content is compiled from third-party sources over which we have no control and for whose accuracy, completeness, or timeliness we accept no responsibility.
• The methods of compilation, processing, aggregation, and presentation of Data Content involve assumptions, estimations, and editorial decisions which may affect the output.
• Data Content may include statistics, forecasts, estimates, projections, and derived metrics which are generated at a particular point in time and which may become outdated or inaccurate as circumstances change.
• We do not independently verify the accuracy or completeness of the underlying third-party source data.

2.1 Data Sources and Licences

Data Content is drawn from many third-party sources, made available under a range of licences and permissions, including the Open Government Licence, Creative Commons licences (some with share-alike or non-commercial conditions) and the Open Database Licence. Each map lists the sources of the data it displays, with their publishers and licences, in its Sources panel, which is updated as data is added or refreshed. 3. No Representations or Warranties#

Your attention is particularly drawn to this section.

We do not and shall not be deemed to give any representation, warranty, undertaking, or guarantee whatsoever (whether express or implied) in respect of any Data Content, including but not limited to:

• the method or quality of compilation, preparation, production, maintenance, currency, or updating of any Data Content;
• the accuracy, completeness, adequacy, reliability, or quality of any assumptions, data, forecasts, projections, estimates, figures, or values used, contained, or reflected in the Data Content;
• that any Data Content is error-free, accurate, comprehensive, complete, or up-to-date;
• that any Data Content is being checked, monitored, maintained, updated, or refreshed on any particular schedule or at all;
• the suitability or fitness of any Data Content for any particular purpose, including any investment, financial, commercial, or operational decision;
• the accuracy or completeness of any geographic data, map visualisations, project location data, or spatial analysis presented through Infra-Maps; or
• that any Data Content will be maintained, corrected, or removed if it becomes or is likely to become outdated or inaccurate, regardless of whether and when we become aware of this.

4. No Reliance#

By accessing or using any Data Content, you acknowledge, confirm, and agree that:

• You use the Data Content entirely at your own risk. No Data Content provided through the Platform constitutes or should be construed as financial advice, investment advice, legal advice, tax advice, or any other form of professional advice.
• You should not rely on Data Content as the sole basis for any investment, financial, business or operational decision or action, and you should independently verify any Data Content that is material to such a decision. Data Content is not a substitute for professional advice, and you should seek your own independent legal, financial, tax and other professional advice as appropriate before making any decision.
• Data Content is presented on a point-in-time basis. Any statistics, forecasts, estimates, or projections represent information generated or compiled at a particular point in time. This information may be outdated, including because it is not updated or is only updated on a periodic basis. As with any statistics, forecasts, estimates, or projections, the Data Content is inherently uncertain and subject to change as matters become known, clearer, or are better understood.
• Past performance is not indicative of future results. Historical data, trends, and patterns presented in the Data Content do not guarantee or predict future outcomes.

5. Limitation of Liability#

Subject to Section 9.1 of the Terms of Use (which sets out liability we do not exclude), and without limiting the other provisions of Section 9 of the Terms of Use, we shall not have nor be deemed to have any duty of care, responsibility, obligation, or liability whatsoever in relation to any Data Content, including:

• any direct, indirect, or consequential losses, damages, costs, or expenses arising from or in connection with your use of, or reliance upon, any Data Content;
• any loss of actual or anticipated profits, savings, revenue, business, or opportunity arising from or in connection with any Data Content;
• any decision made or action taken by you or any third party in reliance upon or as a result of any Data Content; or
• any inaccuracy, error, omission, delay, or deficiency in any Data Content, whether or not we were or should have been aware of such inaccuracy, error, omission, delay, or deficiency.

Subject to Section 9.1 of the Terms of Use, you release us (and our directors, officers, employees, agents, affiliates, consultants, contractors, and sub-contractors) from all responsibilities and liabilities whatsoever in relation to the Data Content.

6. Infra-Maps Additional Provisions#

The geographic visualisations provided through Infra-Maps are powered by Mapbox. They present energy and digital infrastructure assets, international investment flows and, as optional overlays, electricity grid and oil and gas pipeline networks, and in future phases may include project locations, planning authority boundaries and other spatial data layers. The following additional provisions apply to all Infra-Maps content:

• Map data, tile layers, and geographic boundaries are provided by third-party mapping services and are subject to those providers’ own terms and accuracy limitations.
• Project locations are plotted from coordinates or grid references supplied by project developers or published in third-party sources. These may be approximate, may represent the general area of a site rather than its precise boundary, and may have been converted between coordinate systems. We may also display locations at reduced precision to protect the confidentiality of sites. Project locations shown on Infra-Maps are indicative only and we do not independently verify them.
• Where several sources describe the same asset, we combine them using our own matching and prioritisation rules. A combined record may therefore differ from any single source, and our matching may occasionally join assets that are separate or separate assets that are the same.
• Infrastructure network data, such as grid and pipeline routes, and any geographic boundaries are derived from publicly available sources, including community-maintained sources such as OpenStreetMap. They may be incomplete, may not show assets that are planned or under construction, and may not reflect the most current regulatory or physical reality.
• Infra-Maps is a visualisation tool and does not constitute a survey, valuation, planning assessment, or any other form of professional geographic or spatial analysis.

7. Infra-Analytics Additional Provisions#

The market intelligence provided through Infra-Analytics is derived from publicly available infrastructure databases and is presented to help users understand broader market trends and context. The following additional provisions apply:

• Analytics dashboards, charts, and reports present aggregated and derived data which involves editorial and methodological decisions. Different methodologies could produce different results.
• Market data, sector breakdowns, investment trend analyses, and similar content are provided for informational purposes only and do not constitute recommendations or endorsements of any project, sector, region, or investment strategy.
• Premium Insights content (available to subscribers) is subject to the same disclaimers as basic analytics. A paid subscription does not confer any additional warranty, guarantee, or assurance as to the accuracy, completeness, or reliability of the Data Content.

8. Sharing of Data Content#

You may share or publish extracts of Data Content only as permitted by Section 4 of the Terms of Use. Where you do so, you must retain the attribution required by that Section and, where you share extracts with Permitted Recipients, you must make them aware that Data Content is indicative only and is provided subject to this disclaimer.

9. Applicable Law#

This disclaimer is governed by and construed in accordance with the laws of England and Wales. The parties agree to submit any dispute to the exclusive jurisdiction of the courts of England and Wales.
